This Legal Notice is published to comply with the disclosure obligations of an e-commerce entity under the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and to make public the intellectual property, regulatory, and identity status of positivecharge.in.

FSSAI licence: Application in process. The licence number will be published on this page and on the Element 1 product page as soon as it is issued. Our contract manufacturer, 3S Fitness Technologies Private Limited, holds its own FSSAI licence No. 10827999000477 and manufactures under that licence pending the issue of our marketer licence.

Product category: Nutraceuticals under FSSAI Category 13.6. Our products are not medicines, drugs, or medical devices.

In accordance with Section 8(9) of the Digital Personal Data Protection Act, 2023, and Rule 3(2) of the IT Intermediary Guidelines, 2021, our designated Grievance Officer is:

5. Trademark and brand notice

The following are the trademarks, service marks, brand elements and trade dress of GSP Horizon, protected under the Trade Marks Act, 1999, the Copyright Act, 1957, the Design Act, 2000, and applicable common law rights of passing off. Trademark and design applications are being progressed in the ordinary course; the display of any mark below does not represent registration status at any specific date, but does constitute a public assertion of the owner's rights, including common law rights of first use:

  • POSITIVE CHARGE (word mark)
  • GSP HORIZON (word mark)
  • The Positive Charge monogram — the interlocked P and C mark
  • The Positive Charge horizontal wordmark
  • The tagline "Elements of Life."
  • The tagline "Live Charged."
  • The product name convention Element 1 — Super Green Blend and future Elements under the same nomenclature
  • The canister and sachet packaging trade dress, including the Charge Green colour with the dotted texture, the giant numeral treatment, and the callout pill layout
  • All illustrations, layouts, product imagery, videos, and copy featured on positivecharge.in or on our packaging.

No person or entity may reproduce, reprint, adapt, transliterate, register in any language or script, or otherwise use any of the above marks or elements without prior written permission from GSP Horizon. Unauthorised use will be actioned under the Trade Marks Act, 1999, the Copyright Act, 1957, and the tort of passing off, with claims for damages, delivery-up and account of profits as available in law.

6. Copyright

All content on positivecharge.in — including text, graphics, code, page structure, typography arrangements, colour choices, illustrations, and photography — is © 2026 GSP Horizon, all rights reserved, unless a separate acknowledgement is displayed.

The following are used on the site under permissive licence and remain the property of their respective owners:

  • Manrope and Inter typefaces, served via Google Fonts under the SIL Open Font Licence 1.1.

Any reproduction, distribution, adaptation, or transmission of content on the site, in whole or in part, in any medium, is prohibited except with the prior written permission of GSP Horizon.

7. Third-party trademarks

positivecharge.in refers to third-party names and marks (for example, Shopify, Razorpay, Stripe, Shiprocket, Delhivery, Google Fonts, and other courier and payment names, and the FSSAI logo where used lawfully). All such names, marks and logos remain the property of their respective owners. Reference to them on our site does not imply any affiliation, sponsorship, or endorsement by those owners of GSP Horizon or Positive Charge, unless we expressly say so in writing.

8. Content, health and product disclaimer

The information on positivecharge.in is provided for general information purposes only. It is not medical advice, and it is not intended to diagnose, treat, cure, or prevent any disease. Statements made on the site have not been evaluated for the treatment of any disease. Individual results may vary.

Our products are nutraceuticals under FSSAI Category 13.6 and are intended for use only by adults aged eighteen (18) years or older. Anyone who is pregnant, lactating, planning to conceive, managing a medical condition, or taking prescribed medication, must consult a qualified physician before consuming our products. Discontinue use and consult a physician if you experience any adverse reaction.

9. No endorsement without written confirmation

Where the site displays an image of, or reference to, any athlete, creator, influencer, doctor, or public figure, no endorsement, sponsorship, or partnership is claimed or implied unless GSP Horizon has expressly published, in writing on the site itself, the specific nature of the collaboration and the compensation involved. Any inference of endorsement drawn from imagery, artistic composition, or general context, without such express written confirmation, is not authorised.

10. Testimonials, reviews, and user content

Customer testimonials and reviews published on the site reflect the personal experience of the individual reviewer at a specific point in time. They are not a guarantee of any outcome for any other individual. Where a reviewer has received any consideration (free product, discount, or payment) for their review, this will be disclosed in accordance with the ASCI Code and applicable Consumer Protection guidelines.

11. Website availability

We make reasonable efforts to keep positivecharge.in available and functioning. However, the site is provided "as is" and "as available", and we do not warrant uninterrupted or error-free access, and we may take any part of the site offline at any time for maintenance, upgrade, security, or any other reason at our discretion.

12. Reservation of rights

GSP Horizon expressly reserves all rights not granted to visitors and customers of the site, including but not limited to the right to modify, update, correct, restrict, or remove any part of the site or any content on it, at any time, without notice, and to enforce every right available to it under Indian law against any unauthorised or infringing use of its property.

14. Complaints and grievances

To raise a complaint or grievance, please write to contact@gsphorizon.com, marking the message with a short description of the issue in the subject line ("Grievance — [short description]"). You may also write to the Grievance Officer at the postal address above. We will acknowledge every properly-directed complaint within seven (7) working days and substantively respond within thirty (30) days.

If you are not satisfied with our response, you may approach:

  • The Data Protection Board of India — for grievances relating to the processing of your personal data under the Digital Personal Data Protection Act, 2023.
  • The National Consumer Helpline (14404 / 1800-11-4000) or the appropriate Consumer Commission established under the Consumer Protection Act, 2019.
  • The Food Safety and Standards Authority of India (FSSAI) — for any food-safety related complaint.

15. Governing law and jurisdiction

This Legal Notice is governed by the laws of the Republic of India. Any dispute arising out of or in connection with this Legal Notice is subject to the dispute-resolution provisions of the Terms of Service, including arbitration seated at Kakinada, Andhra Pradesh, and the exclusive jurisdiction of the competent courts in Kakinada, Andhra Pradesh for all matters not resolvable by arbitration, save as a consumer's rights under the Consumer Protection Act, 2019 otherwise permit.
